Mobile Terms of Service

GhostBed (US)

The GhostBed (US) mobile message service (the "Service") is operated by GhostBed (US) ("GhostBed (US)", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to GhostBed (US)'s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of GhostBed (US) through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with GhostBed (US). Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command stop to (954) 371-2004 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other GhostBed (US) mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any stop or help requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Shipping & Delivery

At this time, Nature's Sleep LLC & GhostBed Inc ships merchandise to locations within the contiguous United States and Canada only. Requests for delivery to U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands, Mexico, or any other international locations must be made by email.

The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

All shipping times are estimates only and we make no guarantees.

There is no expedited shipping available.

No cancellations, address changes, size changes or product changes are permitted after an order has been placed. If an order/item is cancelled, stopped, refused, or returned, then a restocking fee plus return freight will be deducted from any refund. The restocking fee will vary depending on the item.

The sleep trial is a comfort sleep trial and only applies to the GhostBed mattress. It does NOT apply to errors in ordering, size issues, changes in circumstances, buyers remorse etc. Your account will be notated and your sleep trial will be voided if any non-returnable reason has been given.

Orders placed through any 3rd party vendor are subject to that vendor's return policy. All return requests must go through the vendor where the order was placed.

Note: GhostPillows must be returned at the customer's expense.

Due to our extremely quick shipping, we do NOT cancel or change orders after they have been placed. Please verify ALL information for accuracy prior to placing your order as it will be final. This includes changes of address.

Sales Tax

Final selling price includes all applicable state and local sales tax.

Warranties

The information and content on this server is provided "as is" with no warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any warranty that is provided in connection with any of the products can be found at the warranty page here.

The references and descriptions of products or services within the Web site materials are provided "as is" without any warranty of any kind, either express or implied. Industry Allowances

Due to the variations in equipment, machinery and manufacturing, the mattress industry has a 1" variance allowance in terms of measurement.

Return Policy – 101-Night Sleep Trial

The GhostBed 101-Night Sleep Trial is designed to give you the time, comfort, ease and privacy to sleep on your new mattress and discover all of the amazing features and benefits that inspired you to purchase it.

We offer a 101-Night Sleep Trial because we want you to have the time to try your new mattress and make sure it meets all your needs. We encourage you to take your time to experience the GhostBed. Your body needs time to get used to a new mattress, so the first night or two may not be your best night's sleep. After all, you have been sleeping on that old mattress for quite a while. So, give GhostBed the chance to amaze you – no one is pressuring you to decide overnight. We require you to use the mattress for 30 nights but suggest taking 60 nights or up to 90 nights before making your decision, but we've given you 101-Nights to relax and enjoy it.

Day 1 of your 101-Night Sleep Trial will begin on the day your order is shipped to our warehouse.

Please note that our 101-Night sleep trial is applicable only to orders placed directly from GhostBed.com. Orders placed through any other third party vendor must be returned to that third party vendor. Please make your return request directly through them.

If you ultimately decide that the GhostBed mattress is not all you want it to be, simply email us or call us at (954) 371-2004 and we will process your request.

The GhostBed Foundation/Box Spring, GhostBed Adjustable Power Base, GhostBed Sheets, GhostBed Mattress Protector, Adjustable Base Brackets/Legs/Remote, GhostBed T-Shirt and any and all accessories (excluding GhostPillows) do NOT qualify for the 101 night sleep trial and are non returnable. Only the mattress is returnable under the guidelines of the 101 night sleep trial.

Only the GhostBed mattress can be returned under the terms of the 101 Night Sleep Trial. All other items are sold as FINAL SALE. Any final sale item that is refused, returned or canceled will incur a restocking fee, along with freight deducted from your refund.

If any final sale accessory is unused and unopened and is mailed back to us at the customer's expense, any refund issued will be less a restocking fee and shipping charges. The restocking fee and shipping charges will vary dependent on the item. It is up to GhostBed's sole discretion to determine if the item is unused, unopened and in perfect resaleable condition. Shipping the item back to GhostBed is a risk assumed by the customer, not GhostBed. If we deem the item has been opened or used, there will be NO refund issued and the product will NOT be shipped back to the customer.

No address changes, size changes, product changes, etc. will occur after an order is placed. We do NOT cancel an order after it has been placed.

White Glove Delivery, Recycling Fees, Extended Warranties and other service charges will NOT be refunded.

Any topper that remains in customer possession after returning the GhostBed will be deducted from the refund price, at full retail value, or must be donated and acquire a donation receipt.

Your donation receipt must be received in order for a refund to be issued. It must be received no later than 30 days after your 101-Night trial has expired, or the ability to return and secure your refund will NOT be honored. It is the responsibility of the customer to forward the donation receipt back to us.

The sleep trial is a comfort sleep trial only for the GhostBed mattresses. It does not apply to errors in ordering, size issues, changes in circumstances, buyers remorse, etc. GhostBed has the final right of refusal for any sleep trial return and/or refund. Your account will be notated and your sleep trial will be voided if any non-returnable reason has been given.

GhostBed has final right of refusal of the Sleep Trial to anyone exhibiting offensive, inflammatory or abusive behavior.

Note: After your 101-Night Sleep Trial, your GhostBed cannot be returned.

Note: Only one mattress is returnable per household and per person.

Note: GhostPillows must be returned at the customer's expense.

Note: The Sleep Trial is only valid for GhostBed mattresses that remain within the contiguous United States.

Referrals

Referral commissions will be paid after the customer has successfully kept the mattress past the 101 day mark and it is an otherwise uncontested transaction. Only applicable to orders containing a mattress.

Referrals are only valid for orders following the proper procedures.

Promotions

Only one promotional code is allowed per order.

Promotions that include "Free Pillow(s)" or other free items are available for a limited amount of time and are on a first-come basis while supply lasts. Unfortunately, once we are out of stock we are not able to ship the promotional item.

We do not guarantee which free pillow will be received in any free pillow promotion. The free pillow received may vary from the pillow listed on the original order.

Promotions that include multiple products are considered to be one sale. If a mattress within the promotion is returned/donated, the other products must be returned to GhostBed at the customer's expense. If all items are not returned to GhostBed, customer will be charged full price for those items and the value will be deducted from any refund that may be due. All promotional discounts will be applied toward the mattress, including bundle discounts.

Promotional discounts and coupons are not applicable to accessory products, including T-Shirts, Headboard Brackets, Adjustable Base Legs and Replacement Remotes.

Promotions for free pillows require the purchase of a mattress.

Online Voucher Programs

All voucher coupons sales are final and cannot be combined with any other coupon or voucher.

Bitcoin

All orders fully paid by Bitcoin are final and cannot be returned for Bitcoin or hard currency. All returns will be made in the form of store credit and must still follow our return policy.

Restocking Fee

No address changes, size changes, product changes, payment changes etc. will occur after an order is placed. We can NOT cancel or change an order after it has been placed.

If you must cancel or return your order, you will need to contact FedEx with your tracking number and refuse shipment. Once we receive the product back to our warehouse in perfect and unused condition, your refund will be issued with a 15% restocking fee plus shipping charges if applicable, deducted from your order total. Once a cancellation has been requested, the customer's order will be noted that the 101-Night Sleep Trial has been voided.

If you do not or are unable to contact FedEx to cancel, change or refuse the order, it is the customer's responsibility to ship the item back to GhostBed. GhostBed takes no responsibility for the shipping back to us. Restocking and original freight charges will still be deducted from any refund, after inspected and confirmed that the item is unused, unopened and in perfect resalable condition. It is up to GhostBed's sole discretion to determine if the item is unused, unopened and in perfect resaleable condition. If we deem the item has been opened or used, there will be NO refund issued and the item will not be shipped back to the customer. Shipping the item back to us is a risk assumed by the customer, not GhostBed.

Recycling Fee

The states of California, Connecticut and Rhode Island require for mattress recycling fees to be collected and sent directly to the state government to help support their mattress recycling programs. mattressrecyclingcouncil.org. Recycling fees are not refundable.

Miscellaneous

Void Where Prohibited: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. Nature's Sleep LLC & GhostBed Inc and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited.

Governing Law: Both parties agree that in the event of litigation, such litigation shall be brought in the courts of the State of Florida, County of Broward, or, if it has or can acquire jurisdiction, in the United States District Court for the Southern District of Florida, and each of the parties irrevocably consents to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action, suit or proceeding and irrevocably waives any objection to venue laid therein. Both parties expressly waive a trial by jury.

Miscellaneous: The Terms and Conditions constitute the entire agreement between you and Nature's Sleep LLC & GhostBed Inc with respect to this Web site. The Terms and Conditions supercede all prior or contemporaneous communications and proposals, whether electronic, oral or written between you and Nature's Sleep LLC & GhostBed Inc with respect to this Web site. No modification of the Terms and Conditions shall be effective unless it is authorized by Nature's Sleep LLC & GhostBed Inc. If any provision of the Terms and Conditions is found to be contrary to law, then such provision(s) shall be constructed in a manner to closely reflect, as much as possible, the intentions of the parties, with the other provisions remaining in full force and effect.
